Summons for a summary case non traffic?
I received a summons for a non traffic summary case. i have the option to plead guilty and pay $428 fine or plead not guilty. the ticket was for disorderly conduct but i also possessed a small amount of marijuana. if i plead guilty can i get jail time?
This is in PA and I only had a very small amount. not even like $3 worth. The officer said i just have to pay the ticket because it was a disorderly conduct citation. Then the court issued a summons for $428. its a first offense and I just want to pay the fine and end it. I just turned 18 in September if that makes any difference.
Should I send in letter apologizing or something ...to make sure?
If you received a summons and it was stated as above, this is what is called an "Infraction." If you pay the fine you are not even require to go before the judge. It is only if you appear in court to contend the citation that you will be subjected to judicial whim. If you think 428 dollars is reasonable then pay the fine and the answer is no you will not get jail time. The attorney who answered you should be disbarred.
