If presidents of the United States have powers in wartime when the law there is no war?

In WW2 the U.S. said war on Japan and Germany. In the Korean War, they fought against the sovereign nation of North Korea. During the Vietnam War, they fought against the N. Vietnamese National Army. But in Iraq and Afghanistan, the U.S. has not declared war on a sovereign nation or its military. They are committed in police action against a group of non-combatatants. So how is it that Bush or any new U.S. president may have additional powers in time war when he is not legally an official war?
